Agreement

This Agreement, made and entered into the day this form was submitted, is between AeroStar Training Services LLC and the applicant.

Whereas, applicant desires training services from AeroStar Training Services LLC, such as Ground Training and Simulator Training. The Training is provided so that the applicant will meet the minimum requirements of the Federal Aviation Administration (FAA) to acquire an Aircraft Type rating of/for Recurrent Training. The training course is requested by the applicant and taught in accordance with AeroStar Training Services LLC’s FAA-approved core curriculum under Part 141, 61 or 142 of the FAR’s.


All Type Rating Courses Require an iPad 

 

1. Additional Training: If additional training is necessary, it will be at the expense of the applicant.

2. Terms of Payment: Full payment is due 15 business days prior to class start date. All special rate courses must be paid in full at time of booking and are Non refundable. If funds are delayed after the due date, penalty fees may occur. 


3. Initial Payment: All applicants must pay a Non refundable $5,000.00 deposit for type rating courses, full price Non refundable for ATP CTP, and $1,500.00 for Ab Initio for the first installment immediately upon initiating FAA and TSA approvals through AeroStar Training Services LLC’s Admissions Department. 

 

In addition, if an applicant needs an M-1 visa in order to study at AeroStar Training Services LLC’s facility, a separate $200.00 fee is due immediately upon acceptance into a program. Form I-20 will not be processed and sent to the applicant until AeroStar Training Services, LLC receives this  sponsorship fee. This fee is non-refundable under any and all circumstances.

 All training accounts using government vouchers, financing loans, airline sponsorships, or any account that requires extra management outside of normal auditing, will be required to pay an administration fee determined by the school. 

 

4. Training: AeroStar Training Services, LLC shall have the right to determine the daily and hourly training schedules and locations of training hereunder. The applicant agrees that he/she will comply with such schedules as established by AeroStar Training Services LLC. All AeroStar training is IPad based and required for your training material software and simulator training events. 


5. Rescheduling: Rescheduling of confirmed training must be received by AeroStar Training Services, LLC from the applicant in writing no later than 30 days prior to the commencement of the scheduled training program to be eligible for one reschedule. Cancellation of scheduled training with less than 30 days’ notice shall result in forfeiture of the full payment. 

All FAA 141/61 students: A cancellation less than 48 hours will result in a 50% penalty fee of the confirmed time booking(s) or up to $150, whichever is greater. 

 

Under no circumstance will an applicant be refunded any amount of money due to his or her inability to attend the originally scheduled class or due to any other scheduling-related issues once they confirmed the classes and dates. 

6. Unusual Circumstances: AeroStar Training Services, LLC shall not be held responsible for any delay or failure to provide the services herein due to causes beyond its reasonable control.
AeroStar Training Services, LLC shall not be held responsible for mechanical failures of simulators and/or aircraft or crew partner cancellations.

7. Liability: Applicant hereby releases and agrees to defend, indemnify and hold harmless AeroStar Training Services LLC, its affiliates and subsidiaries, their respective officers, directors, employees, instructors, and agents, from and against any and all claims, demands, suits, judgments, damages, liabilities, and losses for the death or injury of any person and damage, losses, or destruction of any property including (without limitation to) aircraft or other property arising out of, or in any way connected with the applicant’s training hereunder.

8. No Other Agreements: This agreement constitutes the entire agreement between the parties with respect to the subject matter hereof, and AeroStar Training Services, LLC shall not be bound by any representations, promises, or inducements relied upon other than those contained herein.

9. Photo Release: While in training, occasional individual or class photos may be taken for marketing and promotional purposes. This agreement releases AeroStar Training Services, LLC from liability for any violation of any personal or proprietary right I may have in connection with the above use. I understand that all recordings of my name, picture, and likeness, in any medium during my training, shall remain the property of AeroStar.

 

10. Attorney’s Fees: In the event that any party to this agreement commences any action or proceeding (including arbitration), including an appeal of an action or proceeding, against the other, or otherwise retains an attorney by any reason of any breach or any claimed breach of any provision of this agreement, or to seek judicial or equitable relief, the prevailing party in such action or preceding shall be entitled to recover his or her reasonable attorney fees or costs.

 

11. Prices: Prices are subject to change without prior notice to the receipt of this agreement and the deposit outlined in paragraph 3. All training funds on account must be used within 90 days of deposit or funds shall be forfeited. If your training is delayed outside of AeroStar's control and program rates increase, the applicant will be responsible to pay the difference in training costs. 

 

12. Pilot Certification: AeroStar will vet all student licenses and certifications however, we have no control over the final determination of the FAA's certification approval process. It is the Pilots responsibility to properly vet their ratings and training courses.
